When does a DUI drop off my record?

Question: I got a DUI in Forsyth County 8 years ago. I was driving through Cumming and I got stopped. I took all those DUI tests and I took a blood test. The blood test came back and was well over the .08 limit. I was also charged with reckless driving, speeding and failure to maintain lane. To be honest, I was drunk and I should not have been driving. But I didn't think I was really drunk.

Now I'm looking to be a Forsyth County deputy sheriff. I've always wanted to be in law enforcement and I got a degree in criminal justice. Since that DUI arrest I have only gotten some speeding tickets and a shop lifting charge; I had a pot charge dismissed. I hope that won't disqualify me from being a cop.

My friend told me that after 7 years a DUI charge drops off of my record. He said that after the 7 years no one would ever know that I was arrested because my record would be totally clean. I need to know if that's true or not.

I live in Cumming with my wife and our 3 kids, who go to the local schools.

Answer: A DUI does not "drop off" your record. There is no provision under Georgia law for a DUI to not be disclosed on your record (i.e., the GCIC Criminal History Information). Even if a DUI charge is reduced to a lesser charge like reckless driving, the arrest will still be indicated on your GCIC. (GCIC stands for Georgia Crime Information Center.) We have seen DUI arrests appear on peoples' records from as far back as the 1960's and 1970's.
