DUI: I was drinking at breakfast

Question: I got arrested in Forsyth County for a DUI after breakfast three days ago. I can't believe that I got busted for DUI after breakfast. I had my usual scrambled eggs, toast and coffee. In the coffee my wife and I always put a little bit of Baileys Irish Cream and sometimes we add Schnapps.

Anyway, after breakfast I got on Georgia 400 to go to work in Cumming and I got stopped by a cop for speeding. The cop asked me if I'd been drinking because he said he smelled alcohol and I told him no. He told me to get out of the car and do some tests for him which I did. The problem is that I almost fell a couple of times. Then I took a breath test on the side of the road and then he arrested me for DUI.

He took me to the Forsyth jail and I took another breath test there and I got a .132. I couldn't believe that I even scored on that test because I don't think I put that much Baileys in the coffee and I think the caffeine in the coffee would have prevented me from getting too drunk. So now I want to talk to someone about getting a Forsyth County DUI lawyer.

Shouldn't the coffee have prevented me from blowing a high number? Do people really get arrested for drunk driving in the morning?

Answer: No, coffee does prevent the absorption of alcohol into the bloodstream. So you can't rely on coffee or other caffeinated drinks to stop you from becoming intoxicated. Coffee, however, is considered by many people to be a hangover cure. That is likely because the caffeine in the coffee acts as a stimulant and can counter the fatigue often associated with a hangover.

As for people being arrested for DUI in the morning, it actually happens more frequently than you might think. Sometimes it's because of drinking in the morning before heading to the road, but many times it's actually because someone has consumed a great deal the night before and the alcohol has not been fully metabolized by the time the person has awakened from sleep and heads off in their car.
