Do I have to keep coming back for my DUI probation?

Question: I need to know about my DUI options. I got a DUI in Atlanta because I got stopped for speeding and I took a breath test and I was well over the limit. So I think I'm going to have a DUI on my record. It's actually not my first DUI. I got one in Florida about 15 years ago. That time I was pretty drunk. This time I was buzzed, but not blasted, if you know what I mean.

I was in Atlanta for a medical convention and I went out with some other neurosurgeons. We drank too much wine and actually had a beer drinking contest. One of the doctors passed out in the bathroom. I took him in my car and tried to drive him home. But we never made it because I got arrested on the way.

I have been to AA and I don't think I still have a problem. I will certainly be more careful in the future, particularly in Atlanta, which is my favorite party town.

Anyway, with that as background, I will call you in the next few days to arrange an appointment and consultation. But I need to know if I get probation do I have to stay in Georgia or can I go back to Florida. And if I can go back, do I have to come to Atlanta every month for probation?

F.V. from Florida

Answer: Many times our DUI clients are allowed to report to probation from their home state. That means they do not have to come back to Atlanta to report for probation. They can report using mail, email or a phone. That saves them time, money and aggravation.

And many, if not all, of the conditions of probation can be satisfied in another state. We'll discuss that at your consultation.
