The Bankruptcy Process in Georgia

Bankruptcy Law is federal law; meaning that the laws that govern the process of filing and navigating a bankruptcy case are supposed to be uniform throughout the entire United States federal court system.

However, courts have their own set of "Local Rules" that indicate how that specific court may interpret Title 11 of the United States Federal Code, which is the title that addresses bankruptcy.

The United States Bankruptcy Court of the Northern District of Georgia holds hearings and meetings in four different locations. Which location you are going to have to travel to will depend on your place of residence within the Northern District. The addresses for the four locations are as follows;

Atlanta Division: Richard B. Russell Federal Building, 75 Spring Street South West, Atlanta, Georgia 30303

Gainesville Division: 121 Spring Street South East, Gainesville, Georgia 30501

Rome Division: 600 East First Street, Rome, Georgia 30161-3187

Newnan Division: 18 Greenville Street, Newnan, Georgia 30263

Check the official website for the Northern District or consult an experienced bankruptcy attorney to find out where you will have to attend your meeting for your case.

The large majority of the time in Chapter 7 bankruptcy cases there is only one instance when you will have to travel to the courthouse. It is referred to as the 341(a) meeting, or better known as the "Trustee Meeting".

At this meeting, you will meet with the trustee that has been appointed to your case. At that meeting, the trustee will verify your identity and may also ask you some questions about your case. It is essential that your attorney be by your side at this meeting to address any issues that may arise.
