My Wife is a Plastic Surgery Addict: Now I Have to File Bankruptcy!

Question: My wife is a plastic surgery addict and now we need to file bankruptcy. For the past 5 years or so my wife has gotten hooked on plastic surgery. She has had many procedures, including breast augmentation, eyelid contouring, a face and neck lift, a forehead and a Brazilian buttock lift. She has also had non-surgical procedures of lip augmentation and Botox. She actually got her ears done by an Atlanta plastic surgeon.

She and a friend are having a competition to see who can get more work done. They call themselves the "plastic ladies of North Fulton County." We live in Alpharetta.

She was never like this when we met in college. She always told me that she wanted to help children with learning disabilities from poor families. But since we got married and I inherited my grandfather's business she has changed little by little. When I told her that I wouldn't by her a BMW she started to cry and she smashed my Rolex watch collection. She was spending almost $10,000 per month on clothes and I had to cancel her credit cards. I was considering a divorce but I don't really want to do that.

I really just need to know if I can get rid of all her plastic surgery debt by filing bankruptcy. Someone told me that cosmetic surgery debt could not be gotten rid of by filing bankruptcy. What can I do now that I am pretty much out of money?

Answer: Money issues certainly can strain a marriage. We see that in our divorce practice all the time. But we are glad that you are trying to move beyond those issues to save your marriage. As for your question, plastic surgery debt, whether incurred for surgical or non-surgical procedures, can be discharged in bankruptcy. It is NOT like child support, student loan debt or IRS tax liens, which are much more difficult to discharge in bankruptcy.

Indeed, medical debt can be discharged (gotten rid of) through a bankruptcy filing. Medical debt is, in fact, a leading cause of bankruptcy. And that is true even if a person has medical insurance.
