Forsyth County: Can I Use a Plea in Absentia For a DUI?

Question: Sadly, I was arrested for DUI in Forsyth County, Georgia. I was in the city of Cumming. I was driving back to my hotel when I was stopped by a Forsyth County deputy sheriff. I admitted that I had been drinking with some colleagues from work. We were drinking at dinner in Alpharetta. I had tequila, beer and flavored vodka.

We work for a multinational company that has offices around the country. Our main Georgia is located in Alpharetta and we want to open an office in Cumming because one of our top executives lives there.

I want to just admit what happened and plead guilty to DUI. I took a breath test and I got a .194. I've heard that many people get arrested for DUI in Forsyth County.

Do I have to go to court if I want to plead guilty? Can my DUI lawyer handle it himself? I really don't want to go back to Cumming.

Answer: While we can understand your reluctance to revisit the scene of your arrest, unfortunately, you do have to be present in court for a DUI plea. A plea in absentia (which is Latin for "while absent") is not available for a DUI charge. There are some charges where a plea in absentia can be utilized. You can often use the plea for charges like speeding and failure to maintain lane, among others.

The good news is that you should only have to appear once in court and your lawyer should be able to have you in and out relatively quickly.
