Bankruptcy: My Husband Doesn’t Want to File

Woman with laptop

Question: I know that we need to file bankruptcy but my husband won't admit it and we keep getting further and further into debt. He keeps using the credit cards and he recently borrowed money from my parents by telling them that he's going to start a business. But he's not going to start a business. He's going to use the money to buy a new Corvette. And he's using the credit cards to pay the mortgage, make car loan payments and to buy expensive clothes. He says he can only wear Italian suits.

We now have over $300,000 in credit card debt. And he borrowed $100,000 from my father. And my husband doesn't even have a job. He just drinks during the day and goes to strip clubs in Atlanta at night. His last credit card statement had charges for escorts and internet porn.

Whenever I tell him we need to file bankruptcy to get rid of all of the debt he just becomes verbally abusive. He's thrown a book at me, spit on me and grabbed my breast. He says he doesn't want to file.

How can I best talk to him about filing for bankruptcy? What should I say? If we don't do something about our debt we'll never pay for our kids' college and our house will get foreclosed, which almost happened last year.

Answer: If you call us to schedule a free consultation we can fully evaluate your financial situation. No one likes to be told what to do, and in many marriages spouses can have a difficult time discussing money issues. Bankruptcy (including chapter 7 and chapter 13) may or may not be your best option. We need to do a full financial assessment to determine what your next steps should be.

Bankruptcy has helped many millions of Americans start fresh and get much needed debt relief. But there may be other options available, including debt negotiation. We'll discuss all of your options.

Many times a spouse does not want to even discuss what options are available. We think a good way of explaining it is that meeting with a bankruptcy attorney for a free consultation does not mean that you must file bankruptcy. It is just an important information gathering tool to ensure that you are making the best decisions.

Since we are well-trained third-parties, we can analyze the situation from a detached, less emotional perspective.
