I Live in Georgia and I’m Being Harassed by Debt Collectors

Question: I live in Georgia and I am being harassed by debt collectors. They call all the time, even on weekends and at night. I don't think the calls will ever stop and they are threatening me with lawsuits now. So I need to file bankruptcy as soon as possible. My wife is starting to have mental issues because of all the phone calls and she's now taking medications for depression and anxiety. Sometimes at night she'll just curl up in the fetal position when the phone rings.

I got the debt over many years and it's credit cards, a repossession, an eviction and some medical debt. It's now at a point where I just can't take it anymore. The phone calls, the stress, and my wife having a mental breakdown every time the phone rings.

I'm a dentist and my wife is a social worker. She had a patient at our house and the phone rang and my wife started crying uncontrollable. That scared the client. And at work I'm losing focus because of all my debt issues. I even put a filling in the wrong tooth of a patient because I couldn't concentrate. Please, I need to go bankrupt.

Answer: Debt issues can cause a great deal of stress. The threat of lawsuits and the constant calling of debt collectors will get anybody stressed out. And we know that debt collectors can harass people by calling almost any time, day or night. We have seen people need prescription medications to deal with the stress.

But the good news is that filing bankruptcy will eliminate your debt and prevent those horrible debt collectors from calling you and your wife. When you file either a chapter 7 or a chapter 13, the phone calls from collectors must stop immediately. If they call after you file, they are breaking the law.

A chapter 7 will eliminate all of the debts you mentioned like car repossession, an eviction, credit cards, medical debt and the lawsuit. If for some reason you don't qualify for a Chapter 7, then we can most likely file a Chapter 13, which will also stop the harassment and eliminate the debts.
