DUI & Vitamins

Question: I was arrested in Alpharetta for DUI. On my video which I assume the cop was taking I'm sure I looked drunk. But I really wasn't drunk. The problems are because I think I took too many vitamins.

I have been training for marathons and I take a lot of supplements. I have been taking vitamins for endurance and to rehab certain injuries from running. I got stopped on Alpharetta Highway when I got into a small accident. I had an open beer in the car and some pot. It was just a joint.

When I got out of the car I was already feeling ill. I had stomach cramps and I thought I'd get diarrhea. I wasn't sure why. I didn't think it was the drinking. I think it was because I took too many vitamins. That day I did a lot of running and I took a bunch of vitamins.

Anyway I looked bad on the video. I could see how someone could think I was drunk. Have you handled any DUI cases involving vitamins?

Answer: Vitamins can have side effects, including cramps, diarrhea and headaches. These can lead to an individual appearing to be under the influence of alcohol, when, in fact, they are not. Vitamins C and D can be associated with these symptoms.

We have used our knowledge of vitamins to defend clients charged with DUI or reckless driving. This defense tactic usually arises when, as in your case, a person does poorly on the field sobriety tests and appears drunk. Many times a prosecutor needs to be shown, oftentimes through published research, that vitamins can have certain side effects.

Sometimes an expert witness must be utilized to testify regarding adverse effects of vitamins.
