Please, I Need to Stop a Wage Garnishment.

Woman and Docs

Question: Please, I need to stop a wage garnishment. They are threatening to take 25% of my gross weekly salary. I can’t afford that. Now I need an Atlanta bankruptcy lawyer to help me.

Human resources at my new company said they received a garnishment notice and that they are going to start taking money out of my check to pay it off. They said it’s a lot of money, 25% of my gross. I think the only way to stop the garnishment is to go bankrupt, to file bankruptcy.

I never expected I’d get garnished. This debt is several years old and it’s for a credit card. I thought I wouldn’t have to pay it back. I thought they wrote it off, or charged it off, and no one cared about it anymore.

The debt Visa says I owe is actually way more than I really owe. They added in all these extra fees. They added in late fees, legal fees, and some other fees. It doesn’t seem fair. And now it’s a lot of money. And I don’t have a lot of money to pay.

I think I remember them suing me, but it was a while ago. I always paid on the credit card but I got into some trouble after losing my job and I couldn’t make all the payments. I called them and told them but they didn’t’ seem to care. I thought Visa would be nice about it, but they weren’t. Visa told me I’m going to have to pay what I owe, so I guess I got mad and didn’t pay them anything.

I lost my job at a big insurance company due to drinking and everything has spiraled out of control financially. But my wife’s gone back to work so it’s not all that bad. Now my new employer told me about the pending garnishment. If I get garnished I won’t be able to pay my bills, like my car and mortgage.

So I need some help fast stopping this garnishment and I’m ready to do whatever it takes, even if it means filing bankruptcy. I need to make the garnishment go away.

Answer: We can stop the garnishment. You need to file bankruptcy to stop the garnishment. When we file either a Chapter 7 or a Chapter 13, the garnishment must stop by law.

Getting garnished can be a scary experience. Georgia law allows a creditor to take up to 25 percent of your gross wages. So, even before taxes are deducted, the creditor can take a big chunk of your check.

Before a creditor can garnish you, they need to get a judgment from a court. Once they get a judgment, they can proceed to garnish your wages. A wage garnishment can be quite painful, because most people need their full salary to pay their bills.

Please contact us as soon as possible so we can prevent you from suffering a wage garnishment.
